Submission of a Rulemaking Petition


In accordance with R.S. 49:964, any interested person may petition DOTD to adopt a new rule, or to amend or repeal an existing rule.  To petition DOTD for changes to the agency’s current rules, or for the adoption of new rules within DOTD's control, an interested person shall submit a written petition to the Department of Transportation & Development, Legal Section (Section 47).  The form for petitioning DOTD may be accessed HERE.

 

  1. The petition shall include:
  2. the petitioner's name and address;
  3. the name of the DOTD office for the rule in question; specific text or a description of the proposed language desired for the adoption or amendment of a rule, or the specific rule and language identified for repeal;
  4. justification for the proposed action; and
  5. the petitioner's signature.

 

The rulemaking petition shall be submitted by certified mail and addressed to:

Consideration of a Rulemaking Petition


Upon receipt, a rulemaking petition shall be forwarded to DOTD for review. Within 90 days of receipt of the rulemaking petition, DOTD shall either:

  1. initiate rulemaking procedures to adopt a new rule, or to amend or repeal an existing rule; or
  2. notify the petitioner in writing of the denial to proceed with rulemaking, stating the reason(s) therefore.

The Louisiana Administrative Code is the state-certified publication that provides a set of rules which have been formally adopted or amended by Louisiana state agencies. Rules are compiled according to topic and are arranged in a codified format (titles, parts, sections, etc.) so that new or amended rules can be easily referenced and researched. The compiled rules in the Louisiana Administrative Code are published in accordance with legislative authority (R.S. 49:953 et seq.) and through legal rulemaking procedure. Titles of the Louisiana Administrative Code are current through the last amended date of publication. Upon promulgation in the Louisiana Register, rules are incorporated into the Louisiana Administrative Code. The last amended date refers to the latest promulgated portion of the specified LAC Title.
